Beta features

Some of our service might be marked as "in beta phase". This means that these parts are under heavy development (normaly new or enhanced features) and malfunctions within these parts are probable. Beta features might or might not be included in the stable list of barValid. While a feature might be free of any charge in the beta phase it can be offered with costs after the transition to a stable feature.

Acceptable use

You must not use our services in any way that causes, or may cause, damage to the services or impairment of the availability or accessibility of the our services; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

You must not use these services to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.

Access to certain areas of this website is restricted. barValid reserves the right to restrict access to areas of this website, or indeed this entire website, at barValid’s discretion.

If barValid provides you with a user ID and password to enable you to access restricted areas of the services or other content or services, you must ensure that the user ID and password are kept confidential.

barValid may disable your user ID and password in barValid’s sole discretion without notice or explanation.

User content

In these terms and conditions, “your user content” means material (including without limitation text, images, user generated content, video material and audio-visual material) that you submit to our services, for whatever purpose.

You grant to barValid a worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, adapt, publish, translate and distribute your user content in any existing or future media.  You also grant to barValid the right to sub-license these rights, and the right to bring an action for infringement of these rights.

Your user content must not be illegal or unlawful, must not infringe any third party's legal rights, and must not be capable of giving rise to legal action whether against you or barValid or a third party (in each case under any applicable law).

You must not submit any user content to the services that is or has ever been the subject of any threatened or actual legal proceedings or other similar complaint.

Our services are provided “as is” without any representations or warranties, express or implied. barValid makes no representations or warranties in relation to our services or the information and materials provided on this website.

Without prejudice to the generality of the foregoing paragraph, barValid does not warrant that:

• user generated content on our services are correct and complete

Limitations of liability

Other parties

You accept that, as a limited liability entity, barValid has an interest in limiting the personal liability of its officers and employees. You agree that you will not bring any claim personally against barValid’s officers or employees in respect of any losses you suffer in connection with the service.

You hereby indemnify barValid and undertake to keep barValid indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by barValid to a third party in settlement of a claim or dispute on the advice of barValid’s legal advisers) incurred or suffered by barValid arising out of any breach by you of any provision of these terms and conditions.
